सुप्रीम कोर्ट से सरकार को झटका, बीसी क्रीमीलेयर संबंधी अधिसूचना रद्द संवैधानिक न्याय की हुई जीत: प्रो. लिम्बा

हरियाणा; सिरसा। सुप्रीम कोर्ट ने मंगलवार को पिछड़ा वर्ग क्रीमी लेयर संबंधी हरियाणा सरकार की 17 अगस्त 2016 व 28 अगस्त 2018 की अधिसूचना रद्द करते हुए प्रदेश के पिछड़ा वर्ग के हक में फैसला सुनाया तथा तीन महीनों में अधिसूचना जारी करने के निर्देश दिए हैं। अपने निर्णय में कोर्ट ने यह भी स्पष्ट किया कि उक्त अधिसूचना के अनुसार जो भी दाखिले हुए हैं, वह प्रभावित नहीं होंगे। पिछड़ा वर्ग कल्याण महासभा हरियाणा के प्रदेश अध्यक्ष प्रो. आर सी लिम्बा ने बताया कि मौजूदा सरकार ने सत्ता में आते ही आरक्षण के संवैधानिक आधार को खत्म करने की नियत से क्रीमीलेयर की सीमा निर्धारण करने हेतु 17 अगस्त 2016 को चुपके से तथाकथित अधिसूचना जारी कर दी और 2 वर्षों तक इसे दबा कर रखा, ताकि पिछड़ा वर्ग में आक्रोश ना फैले, लेकिन जून 2018 में मेडिकल सहित अन्य दाखिलों में इस असंवैधानिक अधिसूचना को लागू कर दिया जिससे हजारों छात्र प्रवेश लेने से वंचित हो गए। इस अधिसूचना में कर्मचारियों की वेतन आय कृषक वर्ग की आय को शामिल कर दिया था, जिससे चपरासी के बच्चे भी आरक्षण दायरे से बाहर हो गए थे। जबकि क्रीमीलेयर को लेकर 1992 में इंदिरा साहनी बनाम यूनियन ऑफ इंडिया मामले में 9 जजों की संवैधानिक पीठ द्वारा सुनाया गया फैसला पूरे भारत में लागू था और है। पिछड़ा वर्ग कल्याण महासभा ने समय-समय पर मंत्रियों सहित मुख्यमंत्री को इस अधिसूचना के कुप्रभावों से अवगत करवाया और इसे रद्द करने की मांग की, लेकिन मुख्यमंत्री की नीति कभी हां कभी ना कि रही। आखिरकार इससे प्रभावित मेडिकल के छात्रों ने हाईकोर्ट की शरण ली, जिसकी महासभा ने हर संभव मदद की। हाईकोर्ट ने 7 अगस्त 2018 को सरकार के इस तरह अगस्त 2016 की अधिसूचना को रद्द किया, जिसके खिलाफ सरकार सुप्रीम कोर्ट चली गई। इसी बीच कोर्ट में जाने वाले छात्रों का सामान्य कोर्ट में दाखिला होने से महासभा ने जनहित को देखते हुए 5 जनवरी 2019 को सुप्रीम कोर्ट में जनहित याचिका संख्या डब्ल्यूपी (सी) 60/219 दायर की। हरियाणा सरकार ने इस केस को लटकाए रखने की नियत से कोर्ट में जवाब नहीं दिया। प्रो. लिम्बा ने बताया कि आखिरकार जस्टिस एल नागेश्वर राव व जस्टिस अनिरुद्ध बोस की पीठ ने 28 जुलाई 2021 को अंतिम बहस पूरी करते हुए फैसला सुरक्षित रख लिया। मंगलवार को फैसला सुनाया गया। महासभा की ओर से सीनियर एडवोकेट पवन अंचल सिद्धार्थ दवे तथा फारूक रशीद की अच्छे से पैरवी के कारण यह जीत संभव हो सकी। इस फैसले से पिछड़ा वर्ग विशेषकर कर्मचारी वर्ग तथा छोटे कृषक वर्ग में खुशी की लहर है। प्रदेशाध्यक्ष प्रो. लिम्बा ने इस लड़ाई को जीतने के लिए कानूनी, सामाजिक व आर्थिक योगदान देने के एडवोकेट पवन आंचल, बीसी के पुरोधा शांता कुमार आर्य, महासभा के महासचिव प्रजापति इंद्र सिंह जाजनवाला व उप प्रधान राजवीर सोनी, रेवाड़ी से अनिल यादव सहित सभी सामाजिक कार्यकर्ताओं, बुद्धिजीवियों व चिंतकों का आभार प्रकट किया।
