हरदोई का अवैध मारुति शोरूम सरकारी जमीन पर बना है, इस बात को उच्च न्यायालय ने भी अब मान लिया है इस कारण 5 जुलाई 2022 को जस्टिस दिनेश कुमार सिंह ने प्रकरण की गम्भीरता व याचिकाकर्ता के अधिवक्ता कृष्ण कुमार सिंह व अंशु सिंह की जिरह को देखते हुए तत्काल प्रभाव से सरकारी जमीन से पंद्रह दिनों के भीतर बेदखली का आदेश पारित किया है। उच्च न्यायालय के आदेश की प्रति आवश्यक अनुपालन कराने हेतु मुख्य सचिव, अपर मुख्य सचिव/प्रधान सचिव राजस्व व जिलाधिकारी हरदोई को भेजी गई है।
गौरतलब है कि उच्च न्यायालय ने रिट याचिका 7472/2021 के आदेश में यह माना है कि वर्ष 1987 में पूर्व आईएएस राधेश्याम अग्रवाल ने नियमविरुद्ध तरीके से सरकारी भूमि का आवंटन ज्ञानयोग धर्मार्थ ट्रस्ट के नाम कराया था। साल 2010 में ट्रस्टी सजीव अग्रवाल ने अपने पुत्र यश वर्धन अग्रवाल व सूर्य वर्धन अग्रवाल व अपने रिश्तेदार प्रदीप अग्रवाल को ट्रस्ट की जमीन का जो विक्रय किया था वह एक दिखावटी लेनदेन व खेली गई धोखाधड़ी है। उच्च न्यायालय ने जिलाधिकारी हरदोई की निष्पक्ष जांच करने को लेकर सराहना की है।
सनद रहे कि 2021 में जब पीएसीएल दाखिल की गई थी तब उच्च न्यायालय को जो जांच रिपोर्ट सौंपी गई थी उस जांच दल का गठन जिलाधिकारी हरदोई द्वारा ही किया गया था। उसी जांच रिपोर्ट के आधार पर ही 35 करोड़ चार लाख 60 हजार रुपए का जुर्माना लगाया था और सजीव अग्रवाल व तत्कालीन उपनिबंधक भगवान सिंह पर एफआईआर जिलाधिकारी के आदेश के बाद ही हो पाना सम्भव हुआ था।
उच्च न्यायालय ने सरकारी जमीन का उपभोग करने को लेकर शोरूम के मालिक सजीव अग्रवाल पर जो पूर्व में 35 करोड़ 4 लाख 60 हजार का जुर्माना लगाया गया था उसके लिए भी एक महीने का समय दिया है।
